Responsabilidad social de la profesiones jurídicas: ética judicial en España

El trabajo lleva a cabo un análisis acerca de los problemas y carencias que se presentan en el modelo judicial en España y la dificultad de ejercer la función judicial en todo su máximo expresión.
Se trata por tanto de hacer un recorrido histórico por la ética del derecho, presentar sus principales posturas y concepciones para obtener una visión general de lo que supone la ética y la moral en el ejercicio del derecho.
Por otro lado, una vez analizada la ética desde una perspectiva histórica, se quiere suscitar la necesidad de la figura de un buen juez, es decir, un juez que verdaderamente cumpla una serie de características que unidas a la ética y la moral se convierta en base de la sociedad y sea ejemplo de hacer justicia.
También, se ponen de manifiesto las carencias que presenta el modelo judicial en España, nacido de la Constitución Española, asumido por la Ley Orgánica del Poder Judicial. Cómo afecta al hacer de los jueces y magistrados en su quehacer diario; Siendo dicho punto uno de los más controvertidos que podemos encontrar en la actualidad en España.
Finalmente, se pone de manifiesto un método que ayude a mejorar cada una de estas carencias y dificultades planteadas a lo largo del mismo, con el objetivo de contribuir a la mejora de la sociedad española mediante la ética y la moral de los juristas.

This paper carries out an analysis about the problems and shortcomings that arise in the judicial model in Spain and the difficulty of exercising the judicial function in all its maximum splendor.
It is therefore a matter of making a historical journey through the ethics of law, presenting its main positions and conceptions to obtain a general vision of what ethics and morals suppose in the exercise of law.
It is exposed, on the other hand, once ethics is analyzed from a historical perspective, we want to raise the need for the figure of a good judge, that is, a judge who truly fulfills a series of characteristics that together with ethics and morals become the basis of society and be an example of doing justice.
Also, the shortcomings of the judicial model in Spain, born of the Spanish Constitution, assumed by the Organic Law of the Judiciary and how it affects the judges and magistrates in their daily work are revealed. Being said point one of the most controversial that we can find at present in Spain.
Finally, a method that helps to improve each of these shortcomings and difficulties raised throughout the same, with the aim of contributing to the improvement of Spanish society through the ethics and morals of the lawyers is highlighted.
