Los registros abiertos de buques : un análisis general

El sistema de registros abiertos (es decir, aquellos en los que el propietario y el
pabellón de registro provienen de diferentes países) ha sido una oportunidad para que
muchos países en desarrollo presten servicios de registros de embarcaciones. Sin
embargo, los registros abiertos, a veces denominados de forma peyorativa como
“banderas de conveniencia”, han sido polémicos desde sus inicios. De hecho, los más
críticos hacia este sistema destacan la facilidad de ocultar la verdadera identidad de
los armadores y la aplicación poco estricta de las normas y regulaciones. En
cualquier caso, su influencia en el coste del transporte es innegable. Por
consiguiente, el objetivo de este trabajo es realizar un análisis de la situación actual
de los registros abiertos, a partir de los antecedentes y estadísticas que muestran la
evolución de este sistema de registro. A parte de esto, el estudio presenta los
antecedentes de la historia de los registros abiertos, sus características, ventajas y
desventajas. Igualmente, se ha considerado de interés presentar una breve exposición
de ciertos registros abiertos, como es el caso de los registros de buques de Panamá,
Liberia y las Islas Marshall.

The system of open registries (that is, where the owner and flag are from different
countries) has been an opportunity for many developing countries to provide the
services of vessel registries. Nevertheless, open registries, sometimes referred to
pejoratively as flags of convenience, have been contentious from the start. In fact,
critics of the system point to the ease of hiding the true identity of ship-owners and
the lax enforcement of rules and regulations. In any case, its influence on the cost of
transportation is undeniable. Therefore, the purpose of this study is to carry out an
analysis of the present situation of the open registers, based on the precedents and
statistics that show the evolution of this system register. In addition to this, the study
presents the antecedents of the history of the open registers, their characteristics,
advantages and disadvantages. Moreover, it has been considered of interest to
present a brief presentation of certain open registers, as is the case of Panama,
Liberia and Marshall Islands shipping registers.
