Este artículo apoya la idea del “control” como elemento inspirador del régimen jurídico aplicable a todos los derechos de garantía mobiliaria, lo que en teoría permite concluir que el sistema es único. Sin embargo, a pesar de esta convergencia, el régimen debe adaptarse a la finalidad de la garantía, para que esta pueda cumplir adecuadamente su función.

This article supports the idea of “control” as an element that inspires the legal regime applicable to all security interests in personal property, which in theory allows us to conclude that the framework is unitary. However, despite this convergence, the regime must be adapted to the purpose of the security, if this is to fulfil its function properly.
