“La víctima en el proceso penal: fortalezas y debilidades”

El presente trabajo tiene por finalidad realizar un análisis sobre las fortalezas y debilidades que presenta la figura de la víctima en el proceso penal español. Para ello, en primer lugar, se analizará la evolución histórica del tratamiento procesal de la víctima en España. Una vez se haya tomado perspectiva sobre cómo se ha alcanzado la situación actual, se estudiará el concepto actual de víctima, así como la clasificación de tipos de víctima a la luz de la normativa actual. A continuación, se examinará en profundidad la Ley 4/2015, de 27 de abril, del Estatuto de la Víctima del Delito, haciendo especial referencia a los derechos, la forma de participación y la protección que este texto legal atribuye a las víctimas.

The purpose of this paper is to an analyze the strengths and weaknesses of procedural treatment given to the victim throughout the Spanish criminal process. Firstly, an overview of the historical evolution of the procedural treatment of the victim in Spain will be provided. Secondly, after perspective has been taken on how the present situation was reached, the current concept of victim will be studied, as well as the classification of types of victims in light of current regulations. To continue, Law 4/2015, of April 27, on the Statute of the Crime Victim, will be examined in depth, making special reference to the rights, the form of participation and the protection that this legal text attributes to the victims.
