La protección civil del honor de la persona fallecida

La aprobación de la LO 1/82 de 5 de mayo de “Protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen” supuso una importante novedad nuestro país en cuanto a la regulación de estos derechos, su protección frente a posibles vulneraciones y su colisión con los derechos, también fundamentales, de libertad de expresión e información. En este trabajo se realizará un estudio de ello y se abordará en profundidad el modo de protección de estos derechos tras el fallecimiento del titular de los mismos, así como los problemas que surgen de su regulación legal y la jurisprudencia de nuestros tribunales en este aspecto debido a la importancia de la misma.

The passing of the law LO 1/82 de 5 de mayo de “Protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen” entailed an important novelty in our country with regards to the regulation of the rights that it encompasses, the protection against possible violations of the said rights, as well as the collision with other fundamental rights, such as the rights of freedom of expression and information.
The purpose of this research paper is to study the above mentioned issues in addition to analyzing in depth the means of protection against the breach of these rights after the death of its legal right-holder. Also, an analysis will be made concerning the problems that may arise: on the one hand, because of its legal regulation, and on the other hand, on the terms of the jurisprudential reaction to the issues, as it is a very relevant aspect when it comes to addressing the study and development of these rights.
