La Ley General de Caminos de Hierro de 3 de junio de 1855

El surgimiento de los ferrocarriles a finales del siglo XVIII en Inglaterra supuso una revolución y cambio en la forma de desplazarse y comunicarse. Las naciones europeas empezaron desarrollar este medio de transporte, siendo fundamental para el despegue de la revolución industrial. Los avances técnicos en el ferrocarril, así como la regulación jurídica de los mismos fueron piezas importantes para el éxito de los ferrocarriles. El presente trabajo analiza los realización y el contenido de la primera ley que reguló en nuestro país el sector ferroviario, mediante una aproximación histórica del momento y de la normativa previa, que permitirá comprender la introducción tardía de este medio de transporte en España. Posteriormente se profundizará en el procedimiento legislativo llevado a cabo, estudiando todas sus fases, sus protagonistas, el contenido y los debates parlamentarios. Conocer el procedimiento y los antecedentes históricos, nos permitirá tener una visión amplia de la materia, así como del desarrollo ferroviario posterior.

The origin of railways in the 18th century in England, provoked an enormous change in the way of communicating and travelling. The European countries began to build and develop railways because it was one of the most important items for the implementation of the Industrial Revolution. The success of this new way of transport, from the 19th century to the 21th century, are based on technical developments of railways and legal regulation. This study will analyse the content and all the works made by the parliament for the approval of the first regulation about railways in Spain. It begins with an explanation of the historic context and the previous regulation for understanding the late introduction of railways in Spain. It continues with the analysis of all the legislative procedure followed in the act, including all the stages that the law passed, the deputies who participate in the drafting of the law, the contents of the act and the parliamentary debates. The studying of the context and the parliamentary process will bring a wide vision of the subject and of the railway development after this act.
