EL SECTOR DE LOS BIOCOMBUSTIBLES: UN ANÁLISIS DEL NUEVO CONTEXTO NORMATIVO EN ESPAÑA Y EUROPA

El siguiente trabajo está motivado por el auge de la preocupación por la sostenibilidad en el mundo actual y el crecimiento exponencial de la inversión en fuentes de energía limpias. Desde las más altas instituciones globales se están planteando ambiciosos objetivos verdes como la Agenda 2030, lo que lleva a la promoción por el uso de recursos energéticos sostenibles.
Este interés generalizado ha ido creciendo a lo largo de los años y se ha podido observar en el último lustro una progresión aún mayor. Los objetivos de sostenibilidad y, con ellos, las regulaciones a todos los niveles se han ido desarrollando y perfeccionando, por lo que el contexto general en España y Europa del sector energético ha sido especialmente cambiante en los últimos años. Por ello merece la pena realizar un profundo análisis del marco regulatorio del sector de los biocombustibles, desgranando pieza a pieza su contexto normativo tanto en España como en Europa.
A lo largo de este trabajo se abordan los aspectos necesarios para poder dar respuesta a esta pregunta, comenzando con un análisis del mercado energético español, centrándonos más adelante en el sector de los biocombustibles y su funcionamiento. En el cuerpo del trabajo se centran los esfuerzos en explicar el funcionamiento del sistema de certificación de biocarburantes, el llamado sistema SICBIOS y su institución reguladora, la CNMC. Este sistema es el encargado de certificar la sostenibilidad de los biocombustibles, que cuenta también con un apartado específico en este TFG.
Por último, tras el desarrollo de todo este análisis se exponen las conclusiones a las que se es posible llegar y se da respuesta a la pregunta de investigación, aportando las opiniones personales que se han alcanzado tras la realización de este trabajo.
The following paper is motivated by the growing concern for sustainability in today's world and the exponential growth of investment in clean energy sources. Ambitious green goals such as the 2030 Agenda are being set from the highest global institutions, leading to the promotion of the use of sustainable energy resources.
This widespread interest has been growing over the years and in the last five years an even greater progression has been observed. Sustainability objectives and, with them, regulations at all levels have been developed and perfected, so that the general context in Spain and Europe in the energy sector has been especially changing in recent years. For this reason, it is worth carrying out an in-depth analysis of the regulatory framework of the biofuels sector, breaking down piece by piece its regulatory context both in Spain and in Europe.
Throughout this work, all the necessary aspects to answer this question are addressed, starting with an analysis of the Spanish energy market, focusing later on the biofuels sector and its functioning. The body of the paper focuses on explaining the functioning of the biofuel certification system, the so-called SICBIOS system, and its regulatory institution, the CNMC. This system is in charge of certifying the sustainability of biofuels, which also has a specific section in this dissertation.
Finally, after the development of all this analysis, the conclusions that can be reached and the answer to the research question are presented, providing the personal opinions that have been reached after carrying out this work.
