El principio de bona fides : de Roma hasta nuestros días

El presente trabajo trata de profundizar en la presencia del principio de la buena fe en el
Derecho Civil, en concreto, en el ámbito del Derecho de obligaciones y contratos y Derechos
reales. La estrecha relación que existe entre el principio de la buena fe y el Derecho Civil se
manifiesta ya en la Antigua Roma y ha perdurado hasta nuestros días. La redacción de
nuestro Código Civil está indudablemente empapada por la buena fe de modo que, a través
del estudio de dicho principio, alcanzaremos una mayor compresión del mismo. Abordaremos
la cuestión mediante la distinción entre la buena fe objetiva y la buena fe subjetiva y,
posteriormente nos centraremos en el funcionamiento de cada una de ellas. En tanto que
España pertenece a la Unión Europea, también analizaremos las implicaciones de la buena fe,
desde la perspectiva de los contratos, en el Derecho comunitario.

This paper tries to go into detail about the presence of the good faith principle in Civil Law,
specifically in the field of Obligation and Contract Law and Real Law. The narrow link
between the good faith principle and Civil Law already appears in the Ancient Rome and has
persisted to this very day. The writing of our Civil Code is undoubtedly infused with the good
faith principle. In such a way that through the study of mentioned principle we will obtain a
better understanding of the Code. We will address the issue by the distinction of the objective
and subjective good faith and afterwards we will focus on the functioning of each one. While
Spain belongs to the European Union, we will also analyze the implications of the good faith
principle from the perspective of the European Contract Law.
