Efectos procesales de la mediación : terminación y ejecución del proceso de mediación

El objeto de este trabajo es el estudio de la terminación del proceso de
mediación, es decir, el momento final del mismo. Este puede concluir habiendo logrado
acuerdo de mediación o finalizado sin haber conseguido alcanzar acuerdo. A partir del
estudio de esta última fase , se observan los efectos que derivan de estas distintas
situaciones. Es un trabajo descriptivo que mediante el análisis de la legislación vigente
va resaltando sus aspectos mas importantes, y apoyándose en desarrollo doctrinal la
profundiza y pone de manifiesto las carencias mas evidentes y aspectos mas
importantes.

The object of this work is the study of the completion of the mediation process,
its final step. This might end having achieved mediation Agreement, or, on the other
hand, it might end without achieving it. From the perspective of this final phase, we
analyze the effects that emerge from both mentioned situations. It is a descriptive study,
that through law analysis points out the most important aspects of this procedure, and
helping itself in doctrine, claims the most evident defects or inconvenients of mediation.
