Criptoactivos: una aproximación técnico-jurídica a su mercado

El presente trabajo tiene como objetivo exponer una visión integral del contexto, la tecnología y, principalmente, los problemas jurídicos que se plantean en el universo de los criptoactivos. Primero, se definirá toda la tecnología subyacente que viabiliza la existencia y operativa de estos. A continuación, se categorizarán todos y cada uno de los criptoactivos que conviven en el mercado con sus principales rasgos. Posteriormente, se analizarán tanto el marco jurídico actual aplicable a los criptoactivos como la propuesta de la UE encargada de verter seguridad jurídica sobre este ecosistema. Por último, se señalarán las tendencias en materia de criptoactivos que están emergiendo en el mercado y que constituyen nuevos retos para el legislador.

The aim of this paper is to present an all-round overview of the context, technology and, particularly, the legal issues behind cryptoassets. First, the underlying technology that supports the existence and viability of cryptoassets will be defined. Afterwards, all the current typologies of cryptoassets that coexist in the market will be spelled out in order to understand their major features. Additionally, the current regulatory framework will be examined together with the newest legislative proposal of the EU, which seeks to create and guarantee legal certainty on this matter. Lastly, the most recent cryptoassets that have emerged in the market will be thoroughly scrutinized along with the legal challenges that now arise for the legislator.
