La protección efectiva de los derechos civiles en el seno de la UE. El supuesto de los derechos LGTBIQ+ en el Grupo de Visegrado

Todo parece indicar que, en los últimos años, se han registrado importantes
retrocesos en materia de derechos humanos del colectivo LGBTIQ+, en los países del
Grupo de Visegrado (Hungría, Polonia, República Checa, Eslovaquia). Sirviéndose de
una metodología de investigación basada, fundamentalmente, en el análisis crítico
sostenido sobre la revisión de la literatura especializada, el presente trabajo se propone
examinar esta situación y, sobre todo, analizar las respuestas que la UE viene planteando
para revertirla. El trabajo concluye afirmando que garantizar los derechos del colectivo
LGBTIQ+ es una obligación para todos los Estados miembros de la UE. Y que existen
motivos de sobra para que las instituciones de la UE activen las pertinentes medidas,
procedimiento de infracción incluido, para asegurar la protección efectiva de los derechos
del colectivo LGBTIQ+, en los países del Grupo de Visegrado.

Everything seems to indicate that, in recent years, there have been significant
withdrawals in terms of human rights of the LGBTIQ+ community, in the countries of
the Visegrad Group (Hungary, Poland, Czech Republic, Slovakia). Using a research
methodology based mainly on specialized critical analysis supported by the review of the
literature, this paper aims to examine this situation and, above all, analyze the responses
that the EU has been proposing to reverse it. The work concludes by stating that
guaranteeing the rights of the LGBTIQ+ collective is an obligation for all EU Member
States. And that there are plenty of reasons for the EU institutions to activate the pertinent
measures, including an infringement procedure, to ensure the effective protection of the
rights of the LGBTIQ+ community in the countries of the Visegrad Group.
