El sistema de elección del CGPJ y sus problemas

El objeto de este Trabajo de Fin de Grado es ahondar en el contexto político y jurídico, desde 1980, año en el que se aprobó la primera Ley Orgánica del Consejo General del Poder Judicial, para determinar las causas y consecuencias del retraso de más de tres años en la renovación del órgano de gobierno de los jueces.

Para ello, se indagará en los principios constitucionales que justifican la existencia del Consejo, entre los que destacan la independencia judicial (artículo 117 CE 1978) y la separación de poderes. Asimismo, se analizará el artículo 122 CE 1978, creador del CGPJ que establece las bases normativas de su actividad, composición, nombramiento y mandato. Por último, se estudiará la legislación de desarrollo que regula el sistema de elección de los miembros del CGPJ, que en un principio fue la Ley Orgánica 1/1980 del CGPJ, pero cinco años después fue derogada para dar entrada a la Ley Orgánica 6/1985 del Poder Judicial, la que ha sufrido varias reformas con el tiempo, entre las que destacan las correspondientes a la Ley Orgánica 2/2001 y 4/2013 de reforma del CGPJ.

The aim of this Final Thesis is to investigate the political and legal context since 1980, year in which the first Organic Law of the General Council of the Judiciary was approved, in order to determine the causes and consequences of the delay of more than three years in the renewal of the Judiciary's governing body.

To this end, we will examine the constitutional principles that justify the existence of the Council, including the judicial independence (article 117 of the Spanish Constitution 1978) and the separation of powers. In addition, Article 122 of the Spanish Constitution will also be analyzed, as it is the creator of the General Council of the Judiciary and therefore establishes the regulatory bases for its activity, composition, appointment, and term of mandate. Finally, the developing legislation that regulates the system of election of the members of the GCPJ will be studied, which was originally the Organic Law 1/1980 of the GCPJ, but five years later was repealed to give way to the Organic Law 6/1985 of the Judiciary, which has undergone several reforms over time, highlighting those corresponding to the Organic Law 2/2001 and 4/2013 on the reform of the GCPJ.
