La publicación de la Propuesta del Parlamento Europeo y del Consejo sobre Mercados de Criptoactivos para aprobar en 2021 un Reglamento es objeto de análisis en este libro, desde la óptica legal y también de la industria de blockchain. Se examina el sistema de circulación de criptoactivos en el marco de la evolución de la teoría del título valor y de las anotaciones en cuenta, en el nuevo marco de digitalización del sistema financiero y de la economía P2P descentralizada vía DLT que permite representar valor a través de estas fichas o tokens negociables en mercados específicos.
The MiCA Proposal of September of 2020 of the Council and the EU Parliament designed for passing-on a EU Regulation in 2020 is herein anaiysed from both a legal and technological applied vewpoint. We examine the system of circulation foreseen for the rights represented in cryptoassets, within the evolving frame of the civil-law theory of secutities and electronic representation of value, within the current context of financial-system digitisation and peer-to-peer decentralised economy, represented by the distributed ledgers, which facilitates the token trading in specific markets.
