The Old City of Jerusalem: From the Tragedy of the Common to Ostrom’s Solution

El presente trabajo tiene por principal objetivo estudiar la Ciudad Vieja de Jerusalén en el contexto de la solución pacífica entre árabes e israelíes. El planteamiento general es entender este espacio santo para las tres religiones monoteístas como un Common-Pool Resource rompiendo con la visión tradicional que lo ha considerado como un Public Good, un Private Good o incluso un Club Good. De esta forma, basándonos en una visión neo-institucionalista se planteará la creación de un Common Property Right Regime basado en los ocho principios de Ostrom como solución a este complicado asunto.
The main purpose of this article is to study the Old City of Jerusalem in the context of proposing a peaceful solution between Arabs and Israelis. The general approach is to view this land that is holy for three monotheistic religions as a common-pool resource, moving away from the traditional vision that has considered it a public good, a private good or even a club good. Thus, we employ a neo-institutionalist vision to outline the creation of a common property regime, based on Ostrom’s eight principles as a solution to this complex issue.
