«Sub speciali cura episcopi dioecesani». Comentario en torno a la especial relación de cuidado entre un instituto religioso de derecho diocesano y el obispo diocesano en la Iglesia latina

El autor estudia la especial relación de cuidado que el Código de Derecho Canónico de 1983 establece entre un instituto religioso de derecho diocesano y el obispo diocesano. La relación entre el obispo diocesano y estos institutos religiosos es distinta a la que le vincula con las personas jurídicas diocesanas y distinta de la que establece con los monasterios de monjas, y tiene el doble objetivo de que ofrecer apoyo y acompañamiento a un instituto religioso, aún en su etapa inicial de vida eclesial, y, al mismo tiempo, respetar la justa autonomía de vida y de gobierno que le corresponde en tanto que instituto religioso aprobado por la Iglesia.

The author looks into the special relationship of care that the 1983 Code of Canon Law sets between a religious institute of diocesan law and the diocesan bishop. The relationship between the bishop and these religious institutes is different from that with the diocesan juridic persons and from that the bishop has with monasteries of nuns and it has the double purpose of providing support and companionship to a religious instituto which is in its early stage of ecclesial life and, at the same time, comply with the just autonomy of life and governance the institute has as approved by the Church.
