Riesgo regulatorio y régimen retributivo de las actividades gasistas

El presente trabajo tiene como objetivo evaluar la conformidad a Derecho, desde la óptica del principio de protección de la confianza legítima, corolario de los principios constitucionales de seguridad jurídica, buena fe e interdicción de la arbitrariedad de los poderes públicos, y de la excepción del riesgo regulatorio, principal excepción que se le opone en el marco de los mercados regulados, de la Circular 4/2020, de 31 de marzo, por la que se establece la metodología de retribución de la distribución de gas natural.
Tras un análisis de los límites del principio de protección de la confianza en relación con el riesgo regulatorio, y de los efectos sobre ambos conceptos de la traslación – del Gobierno a la CNMC – competencial de la retribución de las actividades de distribución del gas operada por el Real Decreto-Ley 1/2019, de 11 de enero, se concluye que en el procedimiento de elaboración de la Circular 4/2020, de 31 de marzo, se incurrió en una quiebra de la confianza legítima susceptible de ser resarcida mediante una declaración de responsabilidad patrimonial de la Administración.

This paper aims to evaluate the adequacy of the Spanish regulation on the fixed income to be received by the natural gas distributors, following the theory of legitimate expectations, and comparing it to its exception in favour of the regulatory risk.
In order to achieve this result, the theory of the legitimate expectations is exposed alongside with the regulatory risk exception, which denies the acceptance of a breach in the legitimate expectations when it comes to regulated markets. The transfer of the authority to regulate on the fixed income to be received by the natural gas distributors, from the Spanish Government towards the Spanish Antitrust body, is also studied, from the perspective of its effects on both the legitimate expectations and the regulatory risk.
With all this in mind, the conclusion is that there was a breach of the legitimate expectations in the forming of the Spanish regulation, and that damages are to claim, should they be proven.
