Nulidad de matrimonio y proceso canónico. Comentario adaptado a la Instrucción Dignitas Connubii

La Iglesia, desde sus orígenes, siempre ha intentado destacar y proteger la grandeza y dignidad del matrimonio, sobre todo en aquellos tiempos en los que los vaivenes culturales han sido más contrarios al mismo. Los nuestros son, precisamente, tiempos difíciles para la institución matrimonial. La realidad de las crisis conyugales no es uno más de los muchos problemas que asaltan al ser humano; se trata de una auténtica patología social, una «nueva enfermedad» epidémica de difícil tratamiento a corto plazo, y cuyas consecuencias han hecho cambiar buena parte de los estamentos sociales, afectando la vida diaria de manera decisiva. La pastoral matrimonial y los tribunales eclesiásticos se encuentran a diario con esta patología de los matrimonios, intentando buscar «soluciones» cuando ello sea posible. La Instrucción «Dignitas connubii» viene a destacar la necesidad de someter la cuestión sobre la nulidad del matrimonio de los fieles a un proceso judicial con todas las garantías. La Iglesia reivindica su competencia sobre estas causas, ya que está en juego la propia existencia del matrimonio; desinteresarse de este problema sería oscurecer la propia sacramentalidad del matrimonio, lo cual, en las actuales circunstancias socioculturales, supondría contribuir firmemente a firmar el acta de defunción del matrimonio como institución.

Since its origins, the Church has always sought to highlight and protect the greatness and dignity of marriage, especially in times when cultural shifts have been more opposed to it. Ours are precisely difficult times for the institution of marriage. The reality of marital crises is not just another issue among the many problems afflicting humanity; it is a true social pathology, a "new epidemic" with no short-term remedy, whose consequences have significantly altered social structures, decisively affecting daily life.

Marital ministry and ecclesiastical tribunals face this pathology of marriages daily, striving to find "solutions" where possible. The Instruction Dignitas connubii emphasizes the necessity of addressing the issue of marital nullity for the faithful through a judicial process with full guarantees. The Church asserts its competence in these cases, as the very existence of marriage is at stake. Ignoring this problem would obscure the sacramentality of marriage itself, which, under current sociocultural circumstances, would strongly contribute to signing the death certificate of marriage as an institution.
