Los efectos de la inmatriculación y el artículo 205 de la Ley Hipotecaria

Con el objetivo de dotar de mayor seguridad al tráfico inmobiliario, la Ley 13/2015 ha modificado sustancialmente el procedimiento inmatriculador por doble título del artículo 205 LH. En el plano formal, el nuevo artículo 205 LH exige que los dos títulos presentados en el Registro de la Propiedad sean públicos. En el plano temporal, debe existir al menos un año de diferencia entre ellos. Asimismo, la reforma ha profundizado en la coordinación entre el Registro de la Propiedad y el Catastro Inmobiliario. Ello ha supuesto la incorporación de la certificación catastral descriptiva y gráfica como documento indispensable en el proceso inmatriculador. Como consecuencia, el Registro de la Propiedad ha adquirido valor añadido, ya que el principio de legitimación registral ahora ampara también a los datos de hecho de las fincas inscritas.

With the purpose of reaching greater real estate safety, the Law 13/2015 has substantially modified the procedure of registration of property by doble public title. At the formal level, the article 205 LH now requires that both titles are public in nature. At the temporal level, both titles shall be separated by one-year difference. In addition, the reform has made further progress in the historically desired coordination between the Property Rights Registry and the Cadastre. In the registration process, such amendment has introduced the necessity to incorporate a cadastral certificate which must be both graphic and descriptive. Accordingly, the Property Rights Registry has gained added value, as the principle of legitimation now also covers the estate’s spatial data.
