Los Centro de Internamiento de Extranjeros en España : marco legal y propuestas de futuro

La Ley de Extranjería y sus sucesivas modificaciones han conformado un marco legal que legitima la creación de los Centros de Internamiento de Extranjeros (CIE), donde los migrantes permanecen retenidos mientras es tramitado su expediente de expulsión. Sin embargo, la justificación de la existencia de dichos centros es cuestionable, y su ambigua regulación normativa, junto con la falta de transparencia, ha derivado en un vivo debate jurídico y social en torno a su función y las posibles violaciones de derechos fundamentales que en su interior se producen. El futuro de estos centros es una incógnita, pues los argumentos que exigen su cierre chocan con la aplicación de legalidad vigente y la escasa predisposición de las instituciones a abordar el problema con la misma perspectiva radical.

The Immigration Act and its successive amendments have formed a legal framework that legitimizes the creation of the Internment Centers for Foreigners (CIE in Spanish), where the migrants remain held while their expulsion expedition is being processed. Nevertheless, the justification of the existence of such internment centers is questionable, since its legal regulation is ambiguous, and together with the lack of transparency, has led to a lively legal and social debate around its function and the violations of fundamental rights that might happen. The future of these centers is not clear at all, since the ones favorable to their closure have to deal with the application of the current legality and the lack of willingness of the institutions to approach the problem with the same radical perspective.
