La usurpación del poder judicial: análisis comparativo de Estados Unidos y España

El Estado de Derecho moderno que predomina en las democracias occidentales se enfrenta a un ataque sin precedentes en la Historia reciente contra la fundamental separación de poderes y, más concretamente, contra la independencia del Poder Judicial. La actual fórmula que predomina en EEUU y España, a pesar de sus diferencias, converge en el tipo de amenaza que procede del poder político al utilizar el sistema de check and balances como medida de control del Poder Judicial. El objetivo de este trabajo es analizar hasta qué punto nos encontramos ante la usurpación política del Poder Judicial, si realmente está en peligro el Estado de Derecho en EEUU y España, y finalmente, si hay solución. Para ello, hemos llevado a cabo un estudio de la evolución histórica y desarrollo de la separación de poderes mediante la contraposición de los distintos planteamientos teóricos, finalizando en una investigación acerca de la tesitura que nos concierne a todos. Los resultados obtenidos nos han ayudado a comprender que, aunque la situación es crítica, el problema es perfectamente perceptible por los ciudadanos, siendo posible así la realización de reformas que fortalezcan las bases de la separación de poderes para que podamos regresar a la esencia de la misma, siendo fiel igualmente a los tiempos actuales.

The modern rule of law that prevails in Western democracies is facing an unprecedented attack in recent history against the fundamental separation of powers and, more specifically, against the independence of the Judiciary. The current formula prevailing in the USA and Spain, despite their differences, converges in the type of threat coming from the political power by using the check and balances system as a measure of control of the Judiciary. The aim of this paper is to analyze to what extent we are facing the political usurpation of the Judiciary, whether the Rule of Law is really in danger in the USA and Spain, and finally, if there is a solution. To this end, we have carried out a study of the historical evolution and development of the separation of powers by contrasting the different theoretical approaches, ending with an investigation of the situation that concerns all of us. The results obtained have helped us to understand that, although the situation is critical, the problem is perfectly perceptible by the citizens, thus making it possible to carry out reforms that strengthen the bases of the separation of powers so that we can return to the essence of the same, being equally faithful to the present times.
