La reforma de la responsabilidad médica en Estados Unidos

Este trabajo analiza la reforma del sistema de res- ponsabilidad médica en los Estados Unidos. Se abor- da tanto el estudio de cuál es la principal causa de incremento del gasto sanitario, si el sistema de res- ponsabilidad médica o la medicina defensiva, como la posición que los dos grandes partidos mantienen en relación a dicha reforma y a sus alternativas y las reformas ya llevadas a cabo en varios Estados. Finalmente, se concluye con una valoración de cual será en el futuro el contenido de la reforma de la responsabi- lidad médica que, necesariamente, parece que debiera afrontar el Congreso de dicho país en esta década

This work analyzes the medical liability reform in the United States of America. We analyze what is the main cause of the increase of health care spen- ding, specifically, if it comes from the medical liabi- lity system or from the defensive medicine. We also study the position of both US political parties, the Republican and the Democrat about the reform of the medical liability system and the different reforms that there have been enacted in the States level. Fina- lly, we try to foresee the future content of the reform of the medical liability system in the US, which the Congress will have to face in the next decade
