La obligación de cotizar a la Seguridad Social

La cotización constituye la principal y más importante fuente de financiación del sistema de la Seguridad Social. Desde su creación, ha sido objeto de numerosas reformas, la mayoría encaminadas a lograr la sostenibilidad, y la mayor proporcionalidad y contributividad de las cotizaciones y prestaciones. Esto ha contribuido a que la cotización se configure como un instrumento complejo, envuelto en un sinfín de leyes, regímenes y particularidades, que regulan su cálculo y la obligación del mismo. La realidad socioeconómica de nuestro país, ha puesto de manifiesto la insostenibilidad del sistema, y es que, desde 2011, se constata la insuficiencia de los ingresos del sistema de la Seguridad Social, incapaces de hacer frente a los gastos del mismo. En consecuencia, el Estado se ha visto obligado a realizar transferencias vía Presupuestos Generales del Estado, lo que ha contribuido al endeudamiento del sistema. Por ello, el objetivo de este trabajo es analizar de forma exhaustiva la obligación de cotizar, y los elementos que la componen. Del mismo modo, trataremos de buscar nuevas alternativas que posibiliten la viabilidad futura del sistema. Para ello, atenderemos a las recomendaciones de la Comisión del pacto de Toledo, así como a otros sistemas del Derecho comparado, que contribuyan a proteger el pilar más importante de nuestro Estado Social, la seguridad social, y, por ende, su principal fuente de financiación, la cotización.

The contribution is the main and most important source of financing the social security system. Since its creation, it has been reformed several times, trying to achieve its sustainability, as well as a greater proportionality and contributory nature of its system. This has helped to make contributions an important and complex instrument, regulated by many laws, regimes and peculiarities that regulate its calculation and obligation. The socioeconomic reality of our country, has shown us the unsustainability of the system. In fact, since 2011, the income of the Social Security system has been insufficient, unable to pay the costs. Consequently, the State has been forced to make transfers with General State Budget, which has contributed to the indebtedness of the system. Therefore, the aim of this project is to analyse in a comprehensive way, the obligation to contribute, as well as, to look for new alternatives that make possible the future viability of the system. To achieve this, we will take into account the recommendations of the Toledo Pact Commission, as well as other systems of comparative law, which contribute to protecting the most important pillar of our welfare State, the Social Security, and therefore its main source of financing, contributions.
