La aprobación de la Ley 8/2021 de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica ha supuesto un cambio significativo en el tratamiento de la persona con discapacidad no sólo a nivel jurídico sino también a nivel social. El objetivo de este trabajo será indagar en las novedades introducidas por la nueva ley con la finalidad de realizar un análisis comparativo entre el sistema jurídico establecido por aquella y el sistema anterior. Para ello, se hará un estudio de la evolución de la legislación civil a lo largo de la historia en materia de discapacidad, la afectación a otras ramas del derecho y se plantearán los nuevos horizontes que se han abierto tras la promulgación de la nueva ley.

The adoption of the Law 8/2021, of 2 June, that reforms civil and procedural legislation to support disabled people in the exercise of their legal capacity has brought a significant change in the treatment of people with disabilities, not only at a legal level but also at a social level. The aim of this paper is to investigate the new features introduced by the new law to carry out a comparative analysis between the legal system established by the new law and the previous system. To this end, a study will be made of the evolution of civil legislation throughout history in the field of disability, the effect on other branches of law and the new horizons that have been opened following the adoption of the new law.
