LA LIBERALIZACIÓN DEL TRANSPORTE FERROVIARIO DE VIAJEROS Y SU INCIDENCIA EN LA EXPLOTACIÓN DE LOS TRENES HISTÓRICOS

La construcción del mercado único europeo ha supuesto la adopción de políticas de transporte ferroviario dirigidas a la eliminación de barreras técnicas y de mercado entre los Estados miembros y la apertura a la libre competencia en el sector. Ello ha requerido la reorganización de los sistemas ferroviarios estatales. En el caso español, el fin del monopolio estatal con la Ley 39/2003 ha marcado el comienzo de un gradual proceso de apertura a la competencia que está próximo a su fin con la transposición de las Directivas del 4º “Paquete Ferroviario”. La circulación de trenes históricos a través de la RFIG como forma de conservación del patrimonio ferroviario no puede ser ajeno a estas transformaciones, y requiere de un encaje especial en el sistema tanto a nivel técnico como de mercado.
En este trabajo se analizará el impacto del proceso liberalizador en la explotación de trenes históricos en España. Partiendo en el primer apartado de la definición de la liberalización ferroviaria, tanto a nivel europeo como a nivel nacional, y considerando el concepto y encaje de los trenes históricos como forma de puesta en valor y conservación de bienes del patrimonio industrial ferroviario en el segundo apartado, se estudiarán los problemas de integración técnica de este tipo de circulaciones en el sistema y las soluciones adoptadas por el legislador y los agentes del sector. En el tercer punto, siguiendo la evolución histórica de la gestión y regulación en la explotación de material histórico, se desarrollarán las distintas normas que actualmente definen su régimen jurídico y que diferencian entre servicios de trenes históricos y turísticos, así como las previsiones futuras. Por último, se abordarán las cuestiones problemáticas que el legislador deberá resolver en la definición de las nuevas normas.

The construction of the European single market has supposed the adoption of railway transport policies directed to the elimination of technique and market barriers between member States and the opening to free competition in the sector. This has required the reorganization of the state railway systems. In the Spanish case, the end of the state monopoly with the Law 39/2003 has marked the beginning of a gradual process of opening to competition that is nearing its end with the transposition of the Directives of the 4th Railway Package. The circulation of historic trains through the RIFG as a way of railway heritage conservation cannot be alien to these transformations and requires a special lace in the system both at a technical and market level.
In this project the impact of the liberalization process in the exploitation of historic trains in Spain will be analyzed. Starting in the first section with the definition of the railway liberalization, both at an European and national level, and considering the concept and lace of the historic trains as a way of value and conservation of industrial heritage assets in the second section, problems of the technical integration of those type of circulations in the system and the solutions adopted by the legislator and the agents of the sector will be studied. In the third point, following the historical evolution in the management and regulation of the historical material circulation, the different rules that define its juridical regime and differ between services of historic and touristic trains as well as future forecasts will be developed. Finally, problematic issues that the legislator will have to solve in the definition of new rules will be addressed.
