La expulsión de un miembro de un instituto religioso por ausencia ilegítima prolongada de la casa religiosa a tenor de los cánones 694 §1, 3º y 696 §1

La vida fraterna en común es considerada como elemento esencial y constitutivo de la vida religiosa. A pesar de ello, la práctica de los últimos años ha demostrado que se presentan situaciones de ausencias ilegítimas de la casa religiosa, en la que los religiosos se sustraen a la potestad legítima del Superior y, en ocasiones, no se pueden localizar. Ante esta realidad, el legislador canónico proporciona los procedimientos administrativos de expulsión del Instituto Religioso, los cuales permiten gestionar y dar respuesta a dichas situaciones complejas con la finalidad de solucionar, con el mayor respeto posible, tanto la situación jurídica del religioso ilegítimamente ausente, como garantizar la disciplina religiosa y la justicia dentro del Instituto.

Life in community is considered an essential and constitutive element of religious life. Nonetheless, the experience over the last years has demonstrated that situations occur that are related to illegitimate absences from the religious house, during which the member of the community distances himself or herself from the jurisdiction of the legitimate Superior and at times cannot be located. Faced with this reality, the canonical legislator provides the administrative procedures for the dismissal from the Religious Institute, which allow managing and responding to these complex situations in order to solve, with the greatest possible respect, both the legal situation of the illegitimately absent member, as well as guarantee religious discipline and justice within the Institute.
