Estudio comparado de las limitaciones a la libertad de movimientos producidas en la unión europea durante la crisis del coronavirus

En este artículo se busca como objetivo general definir la excepcionalidad en el cumplimiento de derechos y libertades, en concreto relativos a la movilidad, en el tiempo de una crisis de salud en los países de la Unión Europea.
Entre los objetivos específicos de la investigación cuyos resultados se pretenden mostrar están: crear y documentar métricas de disrupción en la gobernanza (decisiones impuestas de recortes de la movilidad) y entender cómo y cuándo frente a un shock externo, el gobierno puede (a) decidir un estado de excepción, b) cómo se impone a una población y / o grupos minoritarios a menudo sujetos a discriminación.
Es un estudio comparativo y empírico (cuantitativo) en la naturaleza, y se basa en la teoría de la toma de decisiones en tiempo de excepción, y la confianza/legitimidad del Gobierno. Para comprender el significado de las respuestas del gobierno, se documenta en forma detallada, determinando el momento y el lugar de las decisiones gubernamentales, y cómo se hacen cumplir. Como el contexto de salud y el grado de protección de las libertades varía entre los países europeos, se necesita una perspectiva comparativa.

The general objective of this article is to define the exceptionality in the fulfillment of rights and freedoms, specifically related to mobility, at the time of a health crisis in the countries of the European Union.
Among the specific objectives of the research whose results are intended to be shown are: to create and document governance disruption metrics (imposed decisions to cut mobility) and to understand how and when, in the face of an external shock, the government can (a) decide a state of exception, b) how it is imposed on a minority population and/or groups often subject to discrimination.
It is a comparative and empirical (quantitative) study in nature, and is based on the theory of decision-making in times of exception, and the trust/legitimacy of the Government. To understand the meaning of government responses, it is documented in detail, determining the time and place of government decisions, and how they are enforced. As the health context and the degree of protection of freedoms varies between European countries, a comparative perspective is needed.
