El trabajador en la empresa: el despido y las distintas soluciones jurídicas en situaciones de crisis económicas y sociales.

Este escrito trata de analizar las diferentes vías de despido en el Ordenamiento Jurídico
español, inicialmente en términos globales analizando cuál es la normativa vigente y
cuáles son los tipos de despido utilizados en este momento, diferenciando entre aquellos
que tienen la característica de individual y los colectivos. Se irá realizando un análisis
pormenorizado de cada tipo, con sus correspondientes requisitos, procedimientos y
efectos. La segunda parte se dedicará a desarrollar las diferentes herramientas que se
han utilizado para paliar en el mercado laboral las dos grandes crisis que ha vivido
España en la historia reciente: la Gran Recesión del 2008 y la pandemia mundial a causa
del COVID-19. Para cada una de ellas se profundizará en los instrumentos más
utilizados, como son los ERE y los ERTE y se plantearán alternativas para éstos.

This paper attempts to analyse the different ways of dismissal in the Spanish legal
system, initially in global terms by analysing the current regulations and the types of
dismissal currently in use, differentiating between those that are individual and those
that are collective. A detailed analysis will be made of each type, with their
corresponding requirements, procedures, and effects. The second part will be devoted to
developing the different tools that have been used to alleviate the two major crises that
Spain has experienced in recent history: The Great Recession of 2008 and the global
pandemic caused by COVID-19. For each of them, the most used instruments, such as
the EREs and ERTEs, will be examined in depth and alternatives to these will be
proposed.
