El Brexit y la Libre Circulación de Personas

El presente trabajo tratará de exponer las consecuencias jurídicas del Brexit sobre la libre circulación de personas, pilar fundamental de la ciudadanía de la Unión Europea. Para ello, se examinará en primer lugar la posición que históricamente ha mantenido el Reino Unido en el momento de la creación de este concepto. También se estudiará la importancia de esta libertad en relación con la campaña del Brexit al ser un aspecto central del debate y las concesiones que el resto de Estados miembros estaban dispuestos a realizar para que Reino Unido permaneciese en la Unión. Asimismo, se tratará el tema de la consolidación de derechos en el contexto del Brexit, prestando especial atención a los derechos de los ciudadanos de la UE en el Reino Unido y los de los británicos en la Unión. Por último, se analizará el impacto de la libre circulación de personas en las negociaciones con la Unión para la salida del Reino Unido así como los modelos sobre libre circulación que podrían adoptarse para regular el futuro de la relación entre ambas partes.

This work exposes the legal consequences of Brexit on free movement of persons, a fundamental pillar of the citizenship of the European Union. In order to do so, the position the United Kingdom has historically maintained at the time of the creation of this concept will be examined. The importance of this freedom in relation to the Brexit campaign will also be analyzed, since it is a central aspect of the debate as well as the concessions that the other Member States were willing to make in order for the United Kingdom to remain in the Union. The issue of the consolidation of rights in the context of Brexit will also be addressed, paying special attention to the rights of EU citizens in the United Kingdom and those of the British in the Union. Finally, we will analyze the impact of free movement of persons in the negotiations with the Union for the exit of the United Kingdom as well as the models on free movement that could be adopted to regulate the future of the relationship between both parties.
