Qué rol, qué papel depara hoy o queremos brindar a una garantía real es un
interrogante constante en un escenario donde el paradigma cambia y las bases o
cimientos sobre los que hemos edificado el edificio y la estructura arquitectónica de la
garantía son cuestionados abiertamente. ¿Supone la garantía un vehículo para superar el
conflicto entre acreedores y deudor o simplemente es un canal, uno entre otros, que
inmuniza simplemente, aunque quizás relativamente, los dos riesgos axiales a un
crédito, a saber, la insolvencia y el incumplimiento? Pero, cómo medimos el parámetro
de la eficiencia y quién acaba soportando los riesgos implícitos a la misma?
