DERECHO ADMINISTRATIVO Y MEDIO AMBIENTE: APROXIMACIÓN A LA REGULACIÓN PARA UNA TRANSICIÓN ENERGÉTICA SOSTENIBLE

Este trabajo se centra sobre el tema de las energías porque estamos en una fase de transición primordial. Esa fase obliga al legislador español a adaptar sus textos con la época en la cual vivimos, y con los problemas medioambientales ante los cuales se encuentra España; se trata de la primera parte del desarrollo, es decir estudiar la adaptación de la regulación ante los problemas del medio ambiente y las medidas enérgicas conformes a esta.
En efecto esta fase de transición es ineluctable porque los viejos recursos naturales como el petróleo, el carbón, el gas natural están destinados a desaparecer pronto o a ser abandonados para limitar la contaminación. A la Humanidad le tomó un siglo consumir la mitad de los recursos petroleros, y según investigaciones solo le tomará medio siglo más agotar las reservas por completo . Entonces esa inevitabilidad es culpa no solo de la desaparición forzada de los recursos no renovables, sino también de la contaminación que causan. Será la idea de la segunda parte del desarrollo es decir estudiar la reducción de los efectos nocivos de las energías las mas contaminantes como objetivo inmediato.
La reducción de las energías las mas contaminantes conduce a deber encontrar soluciones para compensarlas. En efecto no se puede parar de usar los recursos no renovables sin proponer alternativas serias, el objetivo de cuidar del medio ambiente no es una razón para limitar el progreso y regresar en términos de avances técnicas. Por lo tanto, España se comprometió con el objetivo 2020 de la Unión Europea de alcanzar el objetivo de tener al menos 20% de energías renovables de la energía primaria . Será la idea del tercero punto del desarrollo, es interesante estudiar el uso ahora automático de las energías sostenibles y sanes para el medio ambiente.
El uso de las energías y la regulación de esas relacionada con el medio ambiente no solo toca España sino toda Europa, y hasta todo el mundo. Es interesante poder comparar la actuación de un país en relación con otro, ver no solo la manera de regular sobre ese tema tan importante sino también la manera de aplicarlas. Será el objetivo de la cuarta y ultima parte del desarrollo, a saber, la experiencia francesa y española sobre la transición energética.

This paper focuses on the theme of energies because we are in a major transition phase. This phase forces the Spanish legislator to adapt its texts to the times in which we live, and to the environmental problems facing Spain; this is the first part of the development, that is to say, to study the adaptation of the regulation to the problems of the environment and the energetic measures in accordance with it.
In fact this transition phase is inescapable because old natural resources such as oil, coal, natural gas are destined to disappear soon or be abandoned to limit pollution. It took mankind a century to consume half of the oil resources, and according to research it will only take half a century more to exhaust the reserves completely. So that inevitability is to blame not only for the forced disappearance of non-renewable resources, but also for the pollution they cause. It will be the idea of the second part of the development that is to study the reduction of the harmful effects of the most polluting energies as an immediate objective.
The reduction of the most polluting energies leads to the need to find solutions to compensate them. Indeed, one cannot stop using non-renewable resources without proposing serious alternatives. The objective of caring for the environment is not a reason to limit progress and return in terms of technical advances. Therefore, Spain has committed itself to the European Union's 2020 target of having at least 20% of primary energy coming from renewable sources. It will be the idea of the third point of development, it is interesting to study the now automatic use of sustainable and healthy energy for the environment.
The use of energy and the regulation of those related to the environment does not only touch Spain but all of Europe, and even the whole world. It is interesting to be able to compare the performance of one country in relation to another, to see not only the way of regulating on this important subject but also the way of applying them. This will be the aim of the fourth and final part of the development, namely the French and Spanish experience of energy transition.
