Capítulo XLIV La convocatoria de juntas generales

Dispone el artículo 117 LJV que el expediente previsto en este capítulo se aplicará en todos los casos en que las leyes permitan solicitar la convocatoria de una junta general, sea ordinaria o extraordinaria. La regulación de la convocatoria de la junta general de socios de las sociedades de capital aparece regulada en los artículos 166 a 178 LSC. En este comentario nos centraremos especialmente en los supuestos de expedientes de jurisdicción voluntaria de la junta general de socios previstos en el artículo 169 LSC.

Article 117 of the LJV provides that the procedure provided for in this chapter shall be applied in all cases in which the laws allow requesting the convening of a general meeting, whether ordinary or extraordinary. The regulation of the calling of the general meeting of shareholders of capital companies is regulated in articles 166 to 178 LSC. In this comment we will focus especially on the cases of files of voluntary jurisdiction of the general meeting of partners provided for in article 169 LSC.
