Fiscal instructor: ¿es el proceso de menores un ejemplo?

El presente trabajo pretende tomar como referencia la actual figura del fiscal instructor existente en el proceso de menores, para tratar de responder a algunas de las incógnitas que surgen en relación con el fiscal instructor que propone instaurar en adultos el anteproyecto de ley de enjuiciamiento criminal. Para ello, se analizarán las funciones del fiscal instructor en menores y las competencias que el anteproyecto regula para el nuevo fiscal instructor de adultos, en un intento de averiguar si la figura existente en menores puede constituir un buen modelo.

This paper aims to take the existing investigating-prosecutor figure within youth justice as a reference, in order to answer some of the doubts that arise in relation to the investigating-prosecutor proposed for adult criminal processes in the latest draft of the Criminal Procedure Act. In order to do so, the functions of the investigating-prosecutor within youth justice will be analyzed and compared with the ones given to the investigating-prosecutor for adults by the draft. This will attempt to find out if the existing figure within youth justice can constitute a good model.
