Los ciberataques y la desinformación en el contexto de las relaciones internacionales y del derecho internacional: análisis de la política exterior rusa.

El hecho de que existan tipos de conductas cibernéticas que están jurídicamente olvidadas y sean, precisamente, las más comunes e indistintamente utilizadas por actores estatales como parte de su política exterior no cumple con las expectativas de seguridad jurídica de nuestros tiempos.

Es por ello por lo que, en el presente trabajo de investigación, se pretende ir un poco más allá al analizar las posibles vías que existen para declarar la responsabilidad internacional de los estados por ciberataques cometidos fuera del contexto de conflictos armados como forma de garantizar la seguridad jurídica y la estabilidad, ya que si una cosa tenemos interiorizada los estudiantes de Derecho es que “Ubi societas, ibi ius”.

The fact that there are types of cyber behaviors that are legally forgotten and are precisely the most common and indiscriminately used by state actors as part of their foreign policy does not meet the expectations of legal security of our times.

For this reason, in this research work, we want to go a step forward by analyzing the possible ways that exist to declare the international responsibility of states for cyberattacks committed outside the context of armed conflicts as a way to guarantee legal security and stability, because if there is something that law students get to internalize throughout the career is that “Ubi societas, ibi ius”.
