La protección del tercero de buena fe en los negocios jurídicos afectados por un error en la identificación de los comparecientes por parte del fedatario público

El objeto del presente Trabajo de Fin de Grado es analizar cómo la protección genérica que el ordenamiento civil español brinda al tercero que obra de buena fe afecta a los negocios jurídicos otorgados ante notario en los que exista un error. Concretamente, un error consistente en la identificación de una de las partes del negocio jurídico por parte del fedatario público que autoriza la elevación a escritura pública del mismo.
Dicho análisis posee interés desde una doble perspectiva:
· Primeramente, un interés relacionado con cuestiones de seguridad jurídica, ya que la cuestión que se plantea posee un carácter eminentemente práctico; y las reflexiones que se realizarán a través de la elaboración de este Trabajo podrían aportar luz sobre la situación de colisión entre bienes jurídicos de gran relevancia que perfectamente se puede dar en la práctica diaria del tráfico jurídico real.
· Por otro lado, un interés académico y científico, puesto que el análisis jurídico de este asunto puede tener utilidad para la mejor comprensión de nuestro ordenamiento jurídico civil y sus instituciones.

The purpose of this Final Degree Project is to analyze how the generic protection that the Spanish civil law provides to a third party who acts in good faith affects legal transactions granted before a public notary in which there is an error. Specifically, an error consisting of the identification of one of the parties to the legal business by the public notary who authorizes its elevation to a public deed.
This analysis is of interest from a double perspective:
· Firstly, an interest related to questions of legal certainty, since the question that arises has an eminently practical nature; and the reflections that will be carried out through the elaboration of this work could shed light on the situation of collision between highly relevant legal assets that can perfectly occur in the daily practice of real legal traffic.
· On the other hand, an academic and scientific interest, since the legal analysis of this matter may be useful for a better understanding of our civil legal system and its institutions.
