La distribución territorial del poder ante la creación de nuevas Comunidades Autónomas

En los últimos años se ha observado que dentro del modelo de distribución del poder del Estado español, el Estado de las Autonomías, han surgido movimientos que abogan por la constitución de su provincia o entidad territorial como una nueva Comunidad Autónoma. Por ello en primer lugar se analiza la concepción jurídica, filosófica y las características de los distintos modelos de distribución del poder y se estudia el Derecho Comparado para entender el marco general español. Se determina que España no es un Estado federal y seguirá un modelo con el máximo nivel de descentralización, tomando elementos del Estado regional y también elementos del federal. Entendiendo el modelo adoptado, se analizan en detalle los artículos 143, 144 y 151 de la Constitución Española en los que se recogen los procedimientos para establecer una Comunidad Autónoma y se determina la legalidad y vigencia del proceso. Finalmente se analiza el contexto actual reflexionando sobre las actuaciones legales de las diversas instituciones y los movimientos políticos que abogan por la creación de una nueva Comunidad. Se determina la legalidad del proceso en el complejo tiempo actual.

In recent years, it has been observed that within the Spanish state's power distribution model, the State of Autonomies, movements have emerged advocating for the constitution of their province or territorial entity as a new Autonomous Community. Therefore, the legal, philosophical conception and characteristics of the different power distribution models are analysed first, and Comparative Law is studied to understand the general Spanish framework. It is determined that Spain is not a federal state and will follow a model with the highest level of decentralisation, taking elements from the regional state and also elements from the federal state. Understanding the adopted model, Articles 143, 144, and 151 of the Spanish Constitution are analysed in detail, in which the procedures to establish an Autonomous Community are determined, and the legality and validity of the process are determined. Finally, the current context is analysed, reflecting on the legal actions of various institutions and the political movements advocating for the creation of a new Community. The legality of the process in the complex present time is determined.
