Guarda y custodia compartida en la jurisprudencia del Tribunal Supremo de 2015 a 2019

En este trabajo se ha estudiado la evolución que ha experimentado el concepto de la custodia compartida, es un tema que ha tenido mucha repercusión en la sociedad debido a todos los cambios que se han experimentado, en particular por la integración de la mujer en el mundo.
También se ha estudiado la evolución jurisprudencial, de una custodia monoparental (un solo progenitor) a una custodia compartida (ambos progenitores). Antes del año 2015 la jurisprudencia española seguía atribuyendo en caso de divorcio, una custodia exclusiva a un progenitor, pero ha ido cambiando la jurisprudencia y en sentencias del Tribunal Supremo como la STS 33/2016 se atribuyó la custodia compartida para ambos progenitores. A demás analizaremos en profundidad el concepto de custodia compartida y todos sus puntos de conflicto para atribuir este tipo de custodia y diferenciaremos el concepto de custodia con el de patria potestad.

This work studied the evolution of the concept of shared custody, an issue that has had a great impact on society due to all the changes that have been experienced, particularly due to the integration of women in the world.
The jurisprudential evolution has also been studied, from single-parent custody (one parent) to shared custody (both parents). Before 2015, Spanish jurisprudence still attributed in case of divorce, sole custody to one parent, but the jurisprudence has been changing and in judgments of the Supreme Court as the STS 33/2016 joint custody was attributed to both parents. In addition, we will analyze in depth the concept of joint custody and all its points of conflict to attribute this type of custody and we will differentiate the concept of custody with the concept of parental authority.
