Escuela Austríaca e Iusnaturalismo

El presente trabajo pretende dar respuesta a las siguientes cuestiones: ¿Puede la Escuela Austríaca incardinarse dentro de alguna de las concepciones tradicionales del derecho: iusnaturalismo, positivismo, realismo? ¿Se trata de un movimiento independiente? En este sentido, expondremos los fundamentos epistemológicos de la Escuela Austríaca. Seguidamente, siguiendo al fundador de la Escuela, Carl Menger, nos aproximaremos al estudio de las ciencias sociales a través de los tres niveles: la acción humana, relaciones de intercambio y las instituciones sociales. Por último, y en base a lo anterior, daremos respuesta a las cuestiones planteadas.

This paper aims to answer the following questions: Can the Austrian School be included in any of the traditional conceptions of law: iusnaturalism, positivism, realism? Is it an independent movement? In this sense, we will present the epistemological foundations of the Austrian School. Then, following the founder of the School, Carl Menger, we will approach the study of social sciences through the three levels: human action, exchange relations and social institutions. Finally, and on the basis of the above, we will answer the questions posed.
