El tratamiento de las victimas especialmente vulnerables en el proceso penal

En este trabajo vamos a analizar la figura de la víctima en el proceso penal, que ha pasado de ocupar una posición relegada, a ser la protagonista de éste. Concretamente, vamos a centrarnos en tres colectivos de víctimas especialmente vulnerables: los menores de edad, las personas discapacitadas y las mujeres víctimas de violencia de género. Respecto de éstos, primero se definirá el colectivo, después se establecerán los factores que hacen a estas personas más vulnerables, y, finalmente, se analizarán las especialidades que surgen en el proceso penal derivadas de la presencia de estos sujetos en él. Para realizar este análisis se profundizará en las leyes creadas específicamente para estos colectivos, debiendo destacar como base la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito. Por último, expondremos algunas de las características comunes para los tres colectivos.

In this work we are going to analyze the figure of the victim in the criminal process, who has gone from occupying a relegated position, to being the main character of it. Specifically, we are going to focus on three particularly vulnerable groups of victims: minors, disabled people and women victims of gender violence. Regarding these, the group will be defined first, then, the factors that make these people more vulnerable will be established and, finally, the specialties that arise in the criminal process derived from the presence of these subjects in it will be analyzed. To carry out this analysis, the laws specifically created for these groups will be delved into, having to highlight Law 4/2015, of April 27, on the Statute of the victim of crime. Finally, we will expose some of the common characteristics for the three groups.
