EL TRATAMIENTO DE LA GESTACIÓN SUBROGADA EN EL DERECHO INTERNACIONAL PRIVADO ESPAÑOL

El presente trabajo analiza el tratamiento de la gestación subrogada en el Derecho Internacional Privado español a través del análisis de la Resolución de la Dirección General de los Registros y del Notariado de 18 de febrero de 2009. Adicionalmente, se estudiará en detalle el tratamiento internacional que recibe la gestación subrogada en diferentes países y se expresará la opinión con respecto a la Resolución basada en las críticas doctrinales que ha ido recibiendo.

This paper analyses the treatment of surrogacy in Spanish Private International Law through the analysis of the Resolution of the General Directorate of Records and Notaries of 18 February 2009. Additionally, the international treatment of Surrogacy in different countries will be studied in detail and an opinion will be expressed regarding the Resolution based on the doctrinal criticisms it has received.
