El sistema de patente europea con efecto unitario

La propiedad intelectual sirve para proteger las creaciones de innovadores que contribuyen cada día más a nuestra evolución. En Europea se ha intentado crear, desde varios años, una patente que sería reconocida en todos los estados miembros. Ese proyecto ha tenido un camino y desarrollo pedregoso pero vera finalmente luz el 01 de Junio de 2023. Lo importante en los albores de este nuevo sistema es el concepto del impacto, clarificar las mejoras que podrá aportar este nuevo proceso tanto al nivel Europeo como al nivel de los individuos. Explicar el efecto, positivo, nulo o negativo, que posiblemente va a dar la nueva patente sobre las ya existentes. Este trabajo se divide en dos partes. La situación actual de la patente europea, con analizar sus éxitos y fracasos, así como la necesidad de crear una nueva herramienta. Así como el largo proceso de desarrollo de la nueva patente unitaria hasta hoy en día y la posición única española.

Intellectual property aim to protect the creations of innovators who contribute more and more to our evolution. In Europe, we have been trying for several years to create a patent that would be recognized in all member states. This project has had a rocky path and development but will finally see the light on June 1, 2023. What is important at the dawn of this new system is the concept of impact, to clarify the improvements that this new process will bring both at the European level and at the level of individuals. To explain the effect, positive, null, or negative, that the new patent will possibly have on the existing ones. This work is divided into two parts. The current situation of the European patent, analysing its successes and failures, as well as the need to create a new tool. As well as the long process of development of the new unitary patent until today and the unique Spanish position.
