Cuestiones de actualidad sobre los delitos contra la integridad moral

En este momento histórico en el que el terrorismo yihadista es una amenaza constante para Occidente, la aplicación del Título VII del Código Penal parece estar a la orden del día. Es por ello que el estudio y análisis de su contenido así como las cuestiones de actualidad que lo atañen merece nuestra especial atención. El Título VII del Código Penal se denomina “De las torturas y otros delitos contra la integridad moral”. En este trabajo analizaremos el concepto de integridad moral tanto desde su perspectiva constitucional como jurídico-penal. Esta delimitación dual nos permitirá tener una visión global sobre este concepto nutrido a través de la doctrina y jurisprudencia española. Asimismo, procederemos a un análisis de los artículos 173.1, 174, 175 y 176 del Código Penal permitiéndonos delimitar las distintas conductas descritas, identificando figuras heterogéneas así como el estudio del bien o bienes jurídicos que protegen. Estas cuestiones de actualidad merecen un estudio ya que los términos utilizados por el legislador en la redacción incitan a la confusión y requieren de un análisis tanto doctrinal como jurisprudencial. Es importante una delimitación tanto del bien jurídico como de las conductas descritas en los distintos artículos para poder obtener una mayor claridad sobre estas cuestiones y poder así garantizar una mayor seguridad jurídica a todos los ciudadanos.

In the precise historical moment we are currently living in, in which jihadi terrorism is a constant threat to Western countries, the application of Title VII of the Spanish Criminal Code seems to be an everyday matter. For this reason, we should pay special attention not only to the analysis and comprehension of its content, but also to the topical issues which demand its application. Title VII of the Spanish Criminal Code addresses issues “on torture and other felonies against moral integrity”. In the course of this assignment, we will analyze the concept of moral integrity both in relation to the Spanish Constitution and the criminal laws. This double-edged approach will provide us the possibility to obtain a global perspective of the concept nourished with the disposals of the Spanish doctrine and jurisprudence. Furthermore, we will proceed to analyze articles 173.1, 174, 175 and 176 of the Spanish Criminal Code, which will enable us to delineate the different behaviors they describe and identify heterogenous figures, as well as the examination of the legal assets which are being protected. The mentioned topical issues are also subject of study, as the wording utilized by the legislator may be confusing and requires of a further doctrinal and jurisprudential analysis. Delimiting both the legally protected assets and the behaviors the mentioned articles describe is a must when wanting to grant legal certainty and to understand with absolute clarity the addressed issues.
