Causas de indignidad para suceder y causas de desheredación : diferencias y similitudes respecto de ambas
instituciones jurídicas y estudio sobre el maltrato
psicológico como causa para desheredar a un
heredero forzoso

El presente trabajo tiene por objeto un estudio exhaustivo de las instituciones jurídicas de la desheredación y la indignidad. A lo largo del mismo se establecen las diferencias, similitudes y distintos ámbitos subjetivos y objetivos relativos a ambas instituciones legales dando lugar a un análisis en profundidad del marco teórico y jurídico tanto de la desheredación como de la indignidad sucesoria.
Además, el trabajo también está ubicado a un estudio pormenorizado de la nueva tendencia jurisprudencial que se viene pronunciando recientemente y a raíz de una sentencia del año 2014 en la cual, y desde entonces, se viene adoptando una línea interpretativa que opta por la adopción de la idea del maltrato psicológico como concepto subsumible en la causa de desheredación de maltrato de obra expresado en el artículo 853.2 del Código Civil.

The target of this piece of work is an exhaustive analysis of the legal institutions of disinheritance and debarment from succession. Throughout this work we will stablish the differences, similarities and different objective and subjective scope of both legal institutions leading to a deep study of the legal and theoretical background of the disinheritance and debarment from succession.
Moreover, this project is also focused on the analysis of the new jurisprudence tendency that the courts have been promoting recently and since one sentence of 2014 in where the interpretation of the psychological abuse has been considered as included of the concept of abuse of deed in one of the causes for disinheritance expressed in the article 853.2 of the Civil Code.
