Análisis del mecanismo de resolución de conflictos de la Unión Africana. El caso de la AMISOM

La Unión Africana (UA) tiene como uno de sus objetivos promover la paz, la seguridad y la estabilidad en el continente africano. El organismo encargado de la prevención, gestión y resolución de conflictos es el Consejo de Paz y de Seguridad dentro de la Unión. Dentro de los principios de su Acta Constitutiva, se encuentra el derecho de ésta de intervenir en un Estado miembro si la Asamblea así lo conviene en situaciones graves, especialmente aquellas relacionadas con crímenes de guerra, genocidios y crímenes de lesa humanidad. Desde su fundación, la UA ha tenido que hacer frente a este tipo de situaciones y desarrollar misiones en distintos territorios africanos para hacer cumplir ese objetivo; sin embargo, existe cierta controversia acerca de cómo se han desarrollado y los resultados que han obtenido estas operaciones, no quedando clara su efectividad en mejorar la situación en estos lugares. Por ello, el objetivo del presente Trabajo de Fin de Grado será comprender el funcionamiento del mecanismo de resolución de conflictos de la Unión Africana; para ello, se analizará una de esas misiones realizadas durante los últimos años, concretamente en Somalia.

One of the main objectives of the African Union (AU) is the promotion of peace, security and stability in the African continent. The organism of the AU in charge of the prevention, management and resolution of conflicts is the Peace and Security Council. Within the principles of its Constitutive Act, it is recognized “the right of the Union to intervene in a Member State pursuant to a decision of the Assembly in respect of grave circumstances, namely: war crimes, genocide and crimes against humanity”. Since its foundation, the AU has been facing this type of situations and has been developing missions in different African territories in order to achieve this aim; however, there is some controversy about how these operations have been managed and the results that have been achieved due to it is not clear its effectivity in improving the situation in that places. Therefore, the main objective of this dissertation will be to understand the operation of the conflict resolution´s mechanism of the AU; with this aim, it will be analyzed one of the missions developed in the last years, specifically in Somalia.
