Resumen
La prisión permanente revisable es una pena indefinida que tras el paso de un
determinado período de tiempo se debe revisar si se ha producido la rehabilitación del
condenado, momento en que se procederá a liberarle. Este tipo de pena se ha
introducido en el Proyecto de reforma del Código Penal español. La mayor parte de la
doctrina y de los juristas opinan que es una medida inconstitucional ya que
principalmente contraviene el principio de resocialización, la dignidad humana y la
prohibición de la tortura y de tratos inhumanos y degradantes.
Life Imprisonment with the possibility of Review is an indefinite sentence of
imprisonment consisting in a sentence that, after the course of a certain period of time,
should be revised in the case that the offender should be considered rehabilitated; if said
offender has been rehabilitated, they should be released from the prison. This type of
penalty has recently been introduced into the draft reform of the Spanish Penal Code;
however, most of the doctrine and jurists claim it is an unconstitutional measure
because it infringes some of the Spanish Constitution's principles, such
as rehabilitation, human dignity and the prohibition of torture and inhuman and
degrading treatment.
