Tratamiento procesal de la víctima

El presente trabajo tiene el objetivo de analizar la figura de la víctima bajo el contexto del proceso penal español. Se tratará de estudiar de una manera detallada la evolución que ha ido experimentado, pasando de ser la gran olvidada en los sistemas de justicia penal a eregirse como la parte principal del proceso. Para ello, iremos analizando punto por punto las principales materias objeto de estudio, con el fin de observar las variaciones que se han ido dando a lo largo de los años alrededor de la víctima, es decir, la evolución de su concepto, regulación, derechos, inclusión como parte en el proceso penal, medidas de protección y recursos para su asistencia en el proceso penal. Por tanto, se analizarán todas aquellas cuestiones que le han dado una importancia prioritaria para protegerla frente a la victimización primaria, secundaria y terciaria. Además, también analizaremos el caso de los menores, que son las víctimas más desprotegidas y que, por tanto, necesitan una mayor protección.

The present work has the objective of analyzing the figure of the victim in the context of the Spanish criminal process. It will try to study in a detailed way the evolution that has been experienced, going from being the great forgotten in the criminal justice systems to establishing itself as the main part of the process. To do this, we will analyze point by point the main subjects under study, in order to observe the variations that have occurred over the years around the victim, that is, the evolution of its concept, regulation, rights, inclusion as a party in the criminal process, protection measures and resources for their assistance in the criminal process. Therefore, all those issues that have given it priority importance to protect it against primar, secondary and tertiary victimization will be analyzed. In addition, we will also analyze the case of minors, who are the most unprotected victims and therefore need greater protection.
