The Environment and Fundamental Rights in the European Convention on Human Rights"

Tradicionalmente, los textos legales sobre derechos humanos fundamentales no han contenido ninguna referencia al medio ambiente. En la Declaración Universal de Derechos Humanos, o en al Convención Europea de Derechos Humanos y Libertades Fundamentales, el medio ambiente no se ha considerado como un derecho merecedor de protección como derecho humano. En este capítulo se analiza la jurisprudencia del TEDH cuando trata de cuestiones ambientales relacionada con derechos tales como la vida, la seguridad física, la intimidad y la inviolabilidad del domicilio.

Traditionally, legal texts on fundamental human rights have not contained any reference to the environment. In the Universal Declaration of Human Rights, or in the
European Convention on Human Rights and Fundamental Freedoms, the environment was not considered to be a legal right worthy of protection as a fundamental human right. In this chapter the case law of the ECHR when dealing with environmental matters will be analyzed, namely concerning to rights to life, to physical safety, to privacy and to the inviolability of the home.
