Sobre la fundamentación política (de la esencia) del Derecho

La fundamentación política constituye uno de los pilares del estudio de La esencia del Derecho (2021), de Luis Carlos Martín Jiménez, sobre
el que pivota la exposición. Se seleccionan doce apartados de los incluidos en la Parte III del mencionado trabajo que propician el despliegue
de comentarios no exentos de digresiones. Desde la representación iconográfica de la justicia hasta la analogía del teatro, la teología, la filosofía
y el Derecho se suceden otros como los referidos a los principios descendente y ascendente de fundamentación de la legalidad, las relaciones
Derecho-Estado, la justicia, la ética y la moral, las instituciones y las normas coactivas, el orden (eutaxia) y la justicia, la tríada dintorno,
entorno y contorno acerca del par Derecho-Política, la propiedad como presupuesto del Derecho, el «género generador» del Derecho, el
iudicium como esencia del Derecho y el desplazamiento de Ius por Directum. El destino del Derecho y, más específicamente de la Iusfilosofía,
puede verse revitalizado a través de su resurrección o reencarnación. La destrucción del Derecho, empero, no se puede descartar, finalmente,
aun cuando la terminación quede desprovista de cierre.

The political foundation constitutes one of the pillars of The Essence of Law (2021), by Luis Carlos Martín Jiménez. This book is the basis of
the exhibition. Twelve sections have been selected from those included in Part III of the aforementioned work, which allow for the deployment
of commentaries, not without digressions. From the iconographic representation of Justice to the analogy of Theatre, Theology, Philosophy
and Law, others follow, such as those referring to the descending and ascending principles of the foundation of legality, Law- State relations,
Justice, Ethic and Morality, institutions and coercive norms, order (eutaxia) and justice, the triad dintorno, entorno and contorno about the
Law-Politics pair, property as a presupposition of Law, the «generative genre» of Law, the iudicium as the essence of Law and the displacement
of Ius by Directum. The destiny of Law, and more specifically of Iusphilosophy, can be revitalized through its resurrection or reincarnation.
The destruction of Law, however, cannot, in the end, be ruled out, even if the termination is devoid of closure.
