El Derecho Sanitario es, el cuerpo normativo hecho de los principios, reglas y disposiciones que tutelan y organizan los intereses y obligaciones de todos los que participan en la relación sanitaria para hacer efectivos sus derechos individuales y el derecho de todos a la protección de la salud.
Dentro del derecho sanitario es quizás la responsabilidad profesional sanitaria la disciplina jurídica que mayor atención suscita no solo ante el incesante incremento en el número de reclamaciones judiciales que se siguen produciendo en el campo de la responsabilidad por daños a la salud, pero igualmente las que se prevén se producirán como consecuencia de la pandemia por COVID-19.
Los motivos de este incesante crecimiento de la litigiosidad son, primero que la relación entre el médico y el paciente ya no descansa tanto en la confianza ó la habilidad del profesional sanitario, si no en su experiencia y capacidad de trabajo, que además resulta que se desarrolla en un medio más tecnificado y especializado, dominado por estructuras públicas, semipúblicas o privadas; segundo, el paciente ya no concibe la salud como suerte, sino que se concibe como derecho, lo que implica un cambio importante de actitud y por último, la superespecialización médica y los enormes avances científicos que se producen casi a diario.
La presente obra, pretende con un carácter eminentemente práctico, analizar los derechos de los pacientes como eje básico de las relaciones clínico – asistenciales, para posteriormente y con base a los pronunciamientos más significativos en la materia, efectuar un estudio de las singularidades existentes en las distintas jurisdicciones, civil, patrimonial y penal.

Health law is the normative body made of the principles, rules and provisions that protect and organize the interests and obligations of all those involved in the health relationship to make their individual rights and the right of all to health protection effective.
Within health law, professional health responsibility is perhaps the legal discipline that gives rise to not only the relentless increase in the number of legal claims that continue to occur in the field of liability for health damage, but also those that are envisaged will occur as a result of the COVID-19 pandemic.
The reasons for this relentless growth in litigation are, first of all, that the relationship between the doctor and the patient no longer rests so much on the trust or skill of the healthcare professional, if not in his experience and ability to work, which also turns out to be developed in a more technified and specialized environment, dominated by public, semi-public or private structures; second, the patient no longer conceives of health as luck, but is conceived as a right, which implies a significant change of attitude and finally, medical superspecialization and the enormous scientific advances that occur almost daily.
This work, aims with an eminently practical nature, to analyze the rights of patients as the basic axis of clinical relationships – care, and subsequently and based on the most significant pronouncements in the matter, to carry out a study of the singularities existing in the different jurisdictions, civil, heritage and criminal.
