POTESTAD LEGISLATIVA Y EVALUACIÓN EX POST DE LAS NORMAS: HACIA UN MEJOR PARLAMENTO A TRAVÉS DE LA REGULACIÓN INTELIGENTE

The development of the normative technique as an expression of the so-called intelligent regulation means promoting the improvement of standards not only from a formal perspective, but also material. In this context, the normative evaluation is of indisputable importance, expressed both in the requirement of ex-ante evaluation and ex-post evaluation. Although the former already enjoys a formal and practical development in our law, the latter has been practically unknown both by the public authorities and by the doctrine. However, there are several elements that allow us to affirm that ex-post evaluation of standards is already a necessity of our legal system, not only for reasons of quality, efficiency and normative efficiency, but also as an instrument that can help to counteract the high degree Of social disaffection shown by our contemporary democracies.
