PERSPECTIVA JURÍDICA DE LOS MICROCRÉDITOS

Comenzamos este trabajo planteando un concepto estándar de lo que podría entenderse por Microcrédito para revisar su trasfondo real y su origen para, entonces, plantear si acaso el concepto de Microcrédito ha cambiado en algo y si es necesaria una adaptación del sistema. Planteamos su posible utilidad hoy en día como una medida de ayuda para afrontar la situación difícil ante la crisis económica y social derivada de la pandemia causada por la COVID-19. Y todo ello lo bajo la lupa de una regulación que no hace sino poner de manifiesto el interés que este tipo de prácticas financieras está suscitando en los países occidentales. Para lograr crear un sistema coherente y homogéneo dentro de este subgénero financiero hemos de plantearnos también si la unificación de las leyes que lo regulan, dada la disparidad de normas, sería una buena opción en pos de facilitar el objetivo de los microcréditos, que no son otros que luchar contra la pobreza y promover la economía doméstica.

We began this work by proposing a standard concept of what could be understood by “Microcredit” in order to review its real background and origin, and then to consider whether the concept of Microcredit has changed at all and whether an adaptation of the system is necessary. We propose its possible usefulness today as a measure to help confront the difficult situation arising from the economic and social crisis caused by the COVID-19 pandemic. And all this is under the watchful eye of a regulation that highlights the interest that this type of financial practice is arousing in Western countries. In order to create a coherent and homogeneous system within this financial sub-genre, we must also consider whether the unification of the laws that regulate it, given the disparity in standards, would be a good option in order to facilitate the objective of micro-credits, which are none other than to fight poverty and promote the domestic economy.
